The Supreme Court held that the Office Memorandum (OM) dated 13th May 1998, which enhanced the retirement age of Central Government Employees to sixty years, does not apply to employees of Public Sector Enterprises (PSEs) unless the relevant rules are amended. The Court found that the Board of Directors of the Fertilizer Corporation of India Ltd (FCIL) had validly decided not to raise the retirement age from fifty-eight to sixty years due to financial implications and operational challenges. Consequently, the appeal by the appellants, who sought to continue in service until sixty years of age, was dismissed, affirming the High Court's ruling.
