Judgment text excerpt

The Supreme Court upheld the Division Bench judgment of the Calcutta High Court, which directed the Howrah Municipal Corporation to grant sanction for the construction of three additional floors to the Ganges Rope Co. Ltd.'s multi-storeyed complex. The Court noted that the Corporation's delay in granting sanction was unjustified and emphasized that the amended Building Rules could not retroactively affect the rights granted by earlier orders. The Court held that the Corporation was bound to comply with the earlier High Court directions despite the subsequent amendments to the Building Rules under the Howrah Municipal Corporation Act 1980.
