The Supreme Court held that the Office Memorandum (OM) dated 13th May 1998, which enhanced the retirement age of Central Government Employees to sixty years, is not applicable to employees of Public Sector Enterprises (PSEs) unless the relevant rules are amended. The Court found that the decision of the Board of Directors of Fertilizer Corporation of India Ltd (FCIL) not to raise the retirement age was valid and that the exemption granted by the Department of Fertilizers was lawful. Consequently, the appeal by the appellants seeking to continue in service until the age of sixty was dismissed.
