The Supreme Court ruled that the Delhi Development Act, 1957 and the Delhi Development Authority (Disposal of Developed Nazul Land) Rules, 1981 govern the lease of Nazul lands. The Court held that the determination of market value by the lessor, as per the sub-lease agreement, is final and binding. The Court found that the government's extension of land rates did not affect the obligation to recover unearned increase, thus upholding the demand for payment based on the agreed market value of Rs.7,50,00,000/- for the land in question.
