Judgment text excerpt

The Supreme Court addressed the unprecedented termination of services of approximately two lakh employees by the Tamil Nadu Government for participating in a strike, challenging the validity of the Tamil Nadu Essential Services Maintenance Act, 2002. The Court reiterated that under Article 226, the High Court has extraordinary jurisdiction, which should be exercised sparingly, especially when alternative remedies exist. The Court held that the High Court's jurisdiction is part of the Constitution's basic structure and cannot be excluded by statutory tribunals, thus allowing the employees to seek relief despite the existence of alternative remedies.
