The Supreme Court upheld the Bombay High Court's decision that certain bulk drugs, including Salbutamol and Theophylline, should not be included in the first schedule of the Drugs (Price Control) Order, 1995 (DPCO), as per Section 3 of the Essential Commodities Act. The Court ruled that the inclusion was contrary to the norms established by the Central Government in the Drug Policy of 1994. Consequently, the notices demanding overcharged amounts from manufacturers were quashed, affirming the High Court's judgment.
