Judgment text excerpt

The Supreme Court held that the Will dated 5.4.1976 executed by Smt. Yamunabai, the mother of the plaintiff, was valid and conferred exclusive ownership of the property to the plaintiff, Smt. Ramabai. The Court found that the lower courts erred in treating the property as ancestral and in dismissing the plaintiff's claim based on the Will. The Court reversed the High Court's decision and restored the decree of the trial court in favor of the plaintiff, affirming her ownership and right to peaceful possession of the property under Section 30 of the Hindu Succession Act, 1956.
