The State of Bihar appealed against a Patna High Court judgment that declared Sections 15(1) and 15(2) of the Bihar Consolidation of Holdings and Prevention of Fragmentation Act, 1956, ultra vires of Articles 13 and 14 of the Constitution. The High Court had further ruled that certain disputes could be entertained by civil courts despite the statutory bars under Sections 4(b), 4(c), and 37. The appellant contended that a prior Full Bench decision in Ramkrit Singh v. State of Bihar had already upheld the validity of these provisions and the corresponding bar on civil court jurisdiction.
