The appellant challenged the acquisition of land for a Krishi Upaj Mandi Yard, alleging that the mandatory inquiry under Section 5A of the Land Acquisition Act was not conducted. The appellant contended that since no such inquiry took place, the proceedings initiated under Sections 4 and 6 were illegal and should be quashed. The matter reached the Supreme Court after a civil suit was deemed not maintainable and a subsequent writ petition was filed in the High Court.
