Judgment text excerpt

The Supreme Court upheld the constitutional validity of the West Khandesh Mehwassi Estate (Proprietary Rights Abolition etc.) Regulation, 1961, which was included in the Ninth Schedule of the Constitution, thereby immunizing it from challenges under Article 19(1)(f). The Court clarified that once a law is included in the Ninth Schedule, it cannot be contested on the grounds of violating fundamental rights. The High Court's decision to strike down the regulation was reversed, affirming the legislative measures that abolished proprietary rights of the Mehwassi Estates.
