The State of Tamil Nadu appealed against a TADA court's judgment acquitting the respondent, Kamaraj, who was accused of harbouring a member of the LTTE involved in a robbery and shooting. The TADA court had acquitted the accused on the grounds that there was insufficient evidence to prove his links to the LTTE movement or his association with the deceased. The Supreme Court reviewed whether the evidence of a few witnesses seeing the accused with the deceased was sufficient to overturn the acquittal.
