Judgment text excerpt

The Supreme Court examined whether a High Court, while hearing a petition under Article 226 and Section 482 CrPC seeking protection from arrest, could simultaneously issue a blanket ban on the production, sale, and advertisement of Pan Masala Gutka. The Court ruled that the High Court exceeded its jurisdiction by passing such prohibitory orders without noticing the aggrieved parties. Consequently, the impugned order was set aside, although the Court noted that such a ban could be considered via a proper application.
