The Supreme Court upheld the Calcutta High Court's decision that the eviction of tenants from the Great Eastern Hotel premises by the State Government was illegal under the Great Eastern Hotel (Acquisition of Undertaking) Act, 1980 and the West Bengal Government Premises (Tenancy Regulation) Act, 1976. The Court found that the tenants had not been given a lawful opportunity to contest their eviction, violating principles of natural justice. Consequently, the Court ruled that the tenants' rights were not automatically terminated and ordered restoration of possession.
