The Supreme Court examined whether the punishment of dismissal for unauthorized absence was disproportionate and whether continuity of service should be granted upon reinstatement. The Labour Court had previously found the dismissal harsh and ordered reinstatement without back wages but with continuity of service. The High Court subsequently modified this award by removing the direction for continuity of service, which the workmen challenged in these appeals.
