Judgment text excerpt

The Supreme Court addressed the validity of a sale deed executed by Smt. Bachan Kaur, who held a life estate in land allotted to her by the Pepsu government. The Court held that under Section 41 of the Transfer of Property Act, a bona fide purchaser from an ostensible owner can acquire title, but this protection does not extend beyond the lifetime of the limited owner. The Court ultimately upheld the High Court's decision that the sale deed was valid, as the respondents were bona fide purchasers for consideration, thus reversing the State of Punjab's appeal.
