Judgment text excerpt

The Supreme Court addressed the validity of the rejection of Vatal Nagaraj's nomination for the Karnataka Legislative Council under Section 81 and Section 100(1)(c) of the Representation of the People Act, 1951. The Court upheld the Karnataka High Court's finding that Nagaraj's position as Chairman of a One Man Commission did not constitute an 'office of profit' under Article 191 of the Constitution, thus ruling the rejection of his nomination as improper. Consequently, the Court affirmed the High Court's decision to declare the election of the other candidates null and void and directed the Returning Officer to accept Nagaraj's nomination.
