Judgment text excerpt

The Supreme Court upheld the eviction of the tenant under Section 15(2)(ii) of the Hyderabad Houses (Rent, Eviction and Lease) Control Act, 1954, confirming that the tenant was a willful defaulter for not paying rent on time after the expiry of the yearly lease. The Court found that the tenant's payment of arrears in a civil suit did not absolve him of the obligation to pay rent within one month after the end of the tenancy. The High Court's ruling that the tenant remained a yearly tenant and was in default was affirmed, leading to the dismissal of the appeal.
