Judgment text excerpt

The Supreme Court upheld the constitutionality of Section 306 IPC, reversing its earlier judgment. The Court found that the conviction under Section 498A IPC could not be sustained due to the null and void nature of the marriage with Mohini, as it occurred during the lifetime of Kalindi. However, the Court affirmed the conviction under Section 306 IPC, concluding that the evidence clearly indicated that Mohini's suicide was a result of torture by both Kalindi and Shiv Charan. The sentence was reduced from seven years to five years of rigorous imprisonment.
