The Supreme Court addressed the issue of permanent absorption of head constables from the Gujarat Police into the Intelligence Bureau, which they had served in since 1991 on deputation. The Court examined the rules framed under Clause (b) of Section 5 of the Bombay Police Act, particularly rule 29(a), which allowed for transfer but did not guarantee permanent absorption. The Court held that while the petitioners had a legitimate expectation for consideration of their absorption, there was no enforceable right to mandate such absorption, thus denying the petitioners' request for a mandamus.
