Judgment text excerpt

The Supreme Court held that under Section 25B(5) of the Delhi Rent Control Act, 1958, the Controller must grant a tenant leave to contest an eviction application if the tenant's affidavit discloses facts that would disentitle the landlord from obtaining possession under Clause (e) of the proviso to Section 14(1). The Court clarified that the Controller's jurisdiction is limited to assessing the affidavit's content without delving into the merits of the case. The eviction order in favor of the landlord was upheld as the tenant failed to provide sufficient grounds to contest the application.
