Judgment text excerpt
The Supreme Court held that in an appeal against acquittal under Section 378 of the Criminal Procedure Code, the High Court should not interfere with the Sessions Court's conclusions if two views are possible. The Court found that the evidence presented by the prosecution was insufficient to establish guilt beyond reasonable doubt, leading to the conclusion that the High Court's conviction under Section 302 read with Section 34 IPC was erroneous. Consequently, the Supreme Court reinstated the acquittal of the appellants.
