The Supreme Court determined that the appellants, who were denied consideration as 'ex-servicemen' for recruitment under the Punjab Recruitment of Ex-servicemen Rules, were indeed eligible based on their service record. The Court interpreted Rule 2(e) of the Rules, which defines 'ex-servicemen', and held that discharge at one's own request does not disqualify an individual from being considered an ex-serviceman if they meet other criteria. Consequently, the Court overturned the High Court's dismissal of the writ petitions and directed that the appellants be considered for appointment as ex-servicemen.
