The Supreme Court held that under Section 14(1)(a) of the Delhi Rent Control Act, a tenant must pay or tender legally recoverable rent within two months of receiving a notice of demand. The Court found that the High Court erred in concluding that the tenant's posting of a rent cheque constituted valid tender despite its non-delivery. The Supreme Court reversed the High Court's decision, reinstating the eviction order against the tenant for non-payment of rent.
