The Supreme Court upheld the decision of the Andhra Pradesh High Court confirming that the lands owned by the respondents were outside the purview of the Urban Land (Ceiling and Regulation) Act, 1976 (UL(C&R) Act). The Court noted that the respondents purchased the land as agricultural land and that at the time of purchase, there were no legal restrictions on the transfer of such land. The Court held that the requirement for a clearance certificate under Section 5(3) read with Section 28(a) of the UL(C&R) Act was not applicable, thus allowing the respondents' application for a layout sanction without such clearance.
