Judgment text excerpt

The Supreme Court held that the Customs, Excise and Gold (Control) Appellate Tribunal misdirected itself by not considering the appellants' request for reclassification of epoxy coils under the correct tariff entry, which was made prior to the Assistant Collector's decision. The Court emphasized that the appellants' amendment to their classification claim should have been acknowledged and considered in the decision-making process. Consequently, the orders of the Assistant Collector, Collector (Appeals), and the Tribunal were set aside, and the matter was remanded for fresh consideration based on the appellants' claims from August 1994.
