Judgment text excerpt

The Supreme Court directed all States and Union Territories to conduct a comprehensive need assessment survey regarding mental health resources and services under the Mental Health Act, 1987, particularly Section 5. The Court mandated the filing of affidavits detailing the status of mental health institutions, compliance with licensing standards, and the existence of unregistered entities. The Union of India was also instructed to establish a Central Government mental health hospital in each State and to formulate uniform service standards for mental health institutions. The deadline for submission of reports and affidavits was set for July 1, 2002, with consequences for non-compliance.
