Judgment text excerpt

The Supreme Court held that the amendment to the Railways Accidents and Untoward Incidents (Compensation) Rules, 1990, as amended in 1997, should apply to the case of P. Suresh Kumar, who died in a train accident. The Court emphasized that denying the appellants the benefit of the enhanced compensation would lead to unfair discrimination, as established in Rathi Menon v. Union of India [2001 (3) SCC 714]. The Court set aside the High Court's judgment and directed that the appellants be awarded compensation in accordance with the amended rules, thereby enhancing the compensation amount.
