The Supreme Court upheld the High Court's decision that the Municipal Corporation of Greater Bombay is the principal employer of the contract workers engaged in solid waste management, as per the provisions of the Contract Labour (Regulation & Abolition) Act, 1970. The Court emphasized that the nature of work performed by the contract labour is perennial and that the Corporation's failure to register as a principal employer and the contractors' lack of licenses under the CLRA Act constituted a violation of statutory obligations. The Court ruled that the contract workers are entitled to the same rights and protections as regular employees of the Corporation under the relevant statutes, including Sections 61(C), 365, and 367 of the Bombay Municipal Corporation Act, 1888.
