Judgment text excerpt

The Supreme Court addressed the applicability of the definition of 'industry' under Section 2(j) of the Industrial Disputes Act, 1947, particularly in relation to charitable trusts. The Court held that the Central Government must notify the enforcement of the amendment to the definition of 'industry' as per the Industrial Disputes (Amendment) Act, 1982, which excludes charitable organizations, and that the delay in enforcement without providing remedies for affected employees is arbitrary. The Court directed the Central Government to decide on the feasibility of enforcing the amendment within six months.
