Judgment text excerpt

The Supreme Court set aside the dismissal of the Plaint under Order VII Rule 11(d) of the Code of Civil Procedure, which was based on the limitation period prescribed under Section 20 of the Maharashtra Land Revenue Code. The Court held that the Appellants should be allowed to amend their Plaint and that the matter should not have been disposed of summarily. The Suit was restored to the High Court for further proceedings, allowing the Appellants to seek necessary amendments.
