The Supreme Court, while adjudicating a petition under Article 32, addressed the grievances of retired employees of Indian Oil Corporation (AOD) regarding the discriminatory cut-off date of December 1, 1994, for pension revision. The Court held that the differentiation between retirees before and after this date was arbitrary and violated the principles established in D.S. Nakara v. Union of India, [1983] 1 SCC 305. Consequently, the Court directed the respondents to extend the revised pension benefits to all retirees, irrespective of their retirement date.
