Judgment text excerpt

The Supreme Court dismissed the landlord's appeal against the High Court's order, affirming that eviction under Section 14(1)(b) of the Delhi Rent Control Act, 1958 was not warranted. The Court held that since six out of eight sub-tenants were inducted with the landlord's consent, the eviction of the primary tenants (respondents 1 to 4) was not justified based on the unauthorized subletting of one sub-tenant (respondent 5). The Court found no illegality in the High Court's decision, thus upholding the lower courts' rulings.
