The Supreme Court held that under Sections 27 and 28 of the Major Port Trust Act, the power to create posts lies with the Board, while the Chairman's authority is limited to posts with a maximum salary of Rs. 1,900. The Court found that the High Court erred in quashing the Chairman's order creating the post of Assistant Engineer, as the maximum salary for the post was within the Chairman's jurisdiction. Consequently, the Supreme Court allowed the appeal and set aside the High Court's order.
