Judgment text excerpt

The Supreme Court held that once land is vested in the State under the Land Acquisition Act, it cannot be re-vested under the West Bengal Estates Acquisition Act. The Court found that the possession of the land was taken on 23rd February, 1955, prior to the notification under the Estates Act, thus establishing that the appellants were entitled to compensation. The judgment of the High Court denying compensation was set aside, and the case was remanded for a decision on the appeal and cross-objection in accordance with law.
