The Supreme Court ruled that the cut-off date of December 1994 for pension calculation under the Assam Oil Company Staff Pension Fund Scheme is discriminatory, violating Article 14 of the Constitution. The Court held that all retirees should be entitled to the revised pension formula, as established in D.S. Nakara v. Union of India, [1983] 1 SCC 305. Consequently, the Court directed the respondents to extend the benefits of the revised pension scheme to all pensioners of Indian Oil Corporation (AOD) regardless of their retirement date.
