The Supreme Court ruled that the Bharathidasan University, established under the Bharathidasan University Act, 1981, is required to seek prior approval from the All India Council for Technical Education (AICTE) before commencing technical courses, as mandated by the AICTE Act, 1987 and its regulations. The Court upheld the decisions of the lower courts, which had relied on the precedent set by the Andhra Pradesh High Court in M. Sambasiva Rao v. Osmania University, affirming that the University falls under the definition of a technical institution as per Section 2(h) of the AICTE Act. Consequently, the admissions made by the University without such approval were ordered to be cancelled.
