The Supreme Court upheld the decision of the Customs Excise and Gold (Control) Appellate Tribunal, which found that the department failed to prove any extra-commercial consideration in the transactions between the appellants and Modi Revlon. The Tribunal determined that similar contracts existed between Modi Revlon and other manufacturers, and the Commissioner's findings were not supported by adequate appreciation of the evidence. The Court concluded that the Tribunal's findings were not perverse and did not warrant interference, thus dismissing the appeals by the Union of India.
