The Supreme Court examined the validity of the Monopolies & Restrictive Trade Practices Commission's order under Section 37(1) of the Monopolies & Restrictive Trade Practices Act, 1969, which found the appellant guilty of a restrictive trade practice for not paying interest on refundable security deposits. The Court held that the practice of non-payment of interest on such deposits, common among public schools, does not constitute a restrictive trade practice as defined under Section 2(o)(ii) of the Act. Consequently, the Court set aside the Commission's order, ruling that it lacked jurisdiction to impose such a penalty.
