Judgment text excerpt

The Supreme Court interpreted Article 30(1A) of the Constitution, which mandates that any law for the compulsory acquisition of property belonging to minority educational institutions must not restrict their rights. The Court held that the provisions of the Land Acquisition Act, 1894, do not apply to the properties of minority educational institutions, thereby quashing the acquisition notifications issued under Sections 4 and 6 of the Act. This judgment reinforces the constitutional protection afforded to minority institutions in managing their properties without state interference.
