Judgment text excerpt

The Supreme Court interpreted Article 30(1A) of the Constitution of India, which mandates that any law for the compulsory acquisition of property belonging to minority educational institutions must not restrict their rights. The Court held that the provisions of the Land Acquisition Act, 1894 do not apply to properties of minority educational institutions, thereby quashing the notifications under Sections 4 and 6 of the Act. This judgment reinforces the constitutional protection afforded to minority institutions in managing their properties without state interference.
