Judgment text excerpt

The Supreme Court reiterated that under Section 15(2)(a) of the Hindu Succession Act, 1956, property inherited by a female Hindu from her mother devolves only upon her daughters and not on the brother of her pre-deceased husband. The Court held that Teja Singh had no right to the property left by Smt. Santi, as it was inherited from her mother, and thus, the earlier decision of the Court from 31.3.1999 was upheld. The appeal was allowed, affirming the legal heirs' right to be heard due to the prior absence of Teja Singh in the proceedings.
