The Supreme Court, while referring to the Presidential Order under Article 371-D of the Constitution, doubted the correctness of previous judgments in State of Andhra Pradesh vs. V. Sadanandam and Govt. of A.P. vs. B. Satyanarayana Rao regarding the interpretation of para 5(2) of the Order. The Court held that the provisions of the Special Rules framed under Article 309 were indeed violative of the Presidential Order, thus upholding the decision of the Andhra Pradesh Administrative Tribunal. The matter was referred to a larger bench for further clarification on the scope of the Presidential Order.
