The Supreme Court held that under Section 5(11)(c) of the Bombay Rent Control Act, 1947, the definition of 'tenant' includes all family members of the original tenant. The Court ruled that the consent decree obtained against the widow of the original tenant is not binding on the son, appellant No.1, as he was not made a party to the eviction suit. Consequently, the execution of the decree against him and his family members was deemed improper, leading to the appeal being allowed in favor of the appellants.
