The Supreme Court ruled that a wife whose husband's property is forfeited under the Smugglers and Foreign Exchange Manipulators (Forfeiture of Property) Act, 1976 (SAFEMA) is entitled to appeal as a person aggrieved under Section 12(4) of the Act. The Court held that the appellant, being the wife of the detenue, has a vested interest in the properties and is thus an aggrieved person. The appeal was allowed, overturning the previous dismissal by the Appellate Tribunal.
