The Supreme Court held that the enforcement of a foreign award under the Arbitration and Conciliation Act, 1996 is applicable if the award was made after the Act's commencement on 25.1.1996, as established in Thyssen Stahlunion GMBH vs. Steel Authority of India Ltd. (1999). The Court found that the High Court erred in dismissing the execution petition on the grounds that the arbitration proceedings commenced prior to the Act's enforcement. Consequently, the Court allowed the appeal, reinforcing the enforceability of the foreign award under the Act.
