The Supreme Court held that the appellants, who were promoted to Fireman Grade A without a written examination, were entitled to be placed senior to those who were promoted after qualifying written tests, as per Clause 5.1 of the Railway Board's circular dated 25.06.1985. The Court found that the restructuring circular did not negate the appellants' prior promotion rights based on service records. Consequently, the Court quashed the Central Administrative Tribunal's order and restored the appellants' seniority over the promotees.
