Judgment text excerpt

The Supreme Court addressed the issue of whether the Market Committee can require producers of cashew kernel to collect market fees from their buyers under the Karnataka Agricultural Produce Marketing (Regulation) Act, 1966. The Court held that since both cashew nut and cashew kernel are Notified Agricultural Produce, the Market Committee is entitled to collect market fees, but it must do so directly from the purchasers rather than through the producers. The judgment clarified the roles of producers and the Market Committee in the collection of market fees under Section 65(2A)(iii) of the Act, affirming the High Court's dismissal of the Appellants' writ petition.
