Judgment text excerpt

The Supreme Court held that the provisions of Section 16G(3)(a) of the Uttar Pradesh Intermediate Education Act, 1921, do not apply to minority institutions, as clarified by Section 30 of the Uttar Pradesh Secondary Education Services Commission and Selection Board Act, 1982, which exempts minority institutions from the requirement of prior approval for termination of services. The Court found that the Allahabad High Court erred in its interpretation, leading to the conclusion that the termination order was invalid due to lack of approval. Consequently, the Supreme Court set aside the High Court's judgment, affirming the validity of the termination order.
