The Karnataka High Court's Division Bench held that the termination of the respondent, a Manager at Canara Bank, was unsustainable due to lack of application of mind by the Disciplinary Authority as per the Canara Bank Officer Employees' (Discipline and Appeal) Regulations, 1976. The Court found that the Appellate Authority also failed to properly consider the appeal, thus vitiating its order. However, instead of reinstatement, the Court ordered the Bank to pay the respondent his salary from the date of dismissal until his enrolment as an advocate, leading to the Bank's appeal against this judgment.
