Judgment text excerpt

The Supreme Court held that the acceptance of delayed payments and interest by the Respondent constituted a deemed extension of time for payment under the auction sale conditions. The Court found that the Appellant had deposited the entire amount due by 27th September 1996, and the subsequent acceptance of payments was valid despite being made after the extended deadline. The Court set aside the High Court's order which had dismissed the Appellant's Writ Petition, ruling that the cancellation of the allotment was unjustified after accepting the payments.
